Evictions are a very unpleasant part of many peoples' lives. It does not matter if you are evicting someone or being evicted by someone you may find yourself involved in a complicated and frustrating situation. The California eviction service is designed to help with the entire process.

Whether you are a landlord trying to remove a tenant from your property or a tenant who feels that they are being wrongfully accused of malfeasance you can find help and guidance there. You can find the proper paperwork and forms to file as well as information as to the validity of your claim.

The most common reason stated for evictions is that the rent has not been paid. These cases rarely go to court and are many times resolved by the renter vacating the premises. It is very important to file the correct paperwork in the proper order in these cases. It is not necessary for the filer to be an attorney but some assistance may be in order for a novice filer.

With only five days to respond to the suit the renter usually needs immediate assistance should they hope to contest the claim. The services provided can advise them as to the validity of their defense. These issues include retaliation, uninhabitable condition of the premises or harassment.

There are free services available that will assist with the filings whether you are the land lord or tenant. The problem you may encounter if you are the tenant is the length of the response time being so short. As with all free services they are very busy and may not have time to assist you. Your relief in this case is that should you win in court the judge may order complainant to pay your legal and filing costs.

When a determination has been reached you must follow through with all final steps to ensure repossession of your property if you are the owner. The sheriff must be notified and paperwork served to the resident. The sheriff will assist with having the tenant vacate the property and then you can have the locks changed and take possession. If any of their belongings remain you must store them for less than a month and notify the tenant in writing if you plan to dispose of them.

A tenant who loses in court has recourse available to them. Paperwork must be filed quickly and prior to moving out of the residence. If the resident can prove to the court that moving will cause an undue burden on the family the court will hear the appeal. Should the court rule in the residents' favor they will be allowed to remain in the house.

Any form of legal notice causes stress for an average person. Evictions are probably the most disruptive of all. They cause entire families to worry about the security of their housing. The California eviction service is designed to assist property owners and tenants alike. The Judicial system can be difficult to follow but with proper guidance and representation it can be less intimidating for everyone.
